T\u00c9RMINOS Y CONDICIONES GENERALES DE CONTRATACI\u00d3N DE SERVICIOS TUR\u00cdSTICOS “LUX ANDES CUSCO”<\/strong><\/p>\n

These General Terms and Conditions for Contracting Tourism Services aim to establish and regulate the rights, obligations, and applicable conditions governing the contractual relationship between LUX ANDES CUSCO, identified with RUC No. 20616590201, domiciled at Urb. San Antonio District, province and department of Cusco, Peru (hereinafter, \"THE AGENCY\"), and the natural person or legal entity requesting, contracting, reserving, or purchasing any of the tourism services offered by the former (hereinafter, \"THE CLIENT\" and\/or \"THE PASSENGER,\" as applicable).<\/p>\n

The contracting of any service offered by THE AGENCY, as well as the acceptance of a quote or commercial proposal, reservation confirmation, payment processing, or any other express manifestation of consent made by THE CLIENT through the official service and sales channels provided by THE AGENCY\u2014including, among others, its website, email, digital forms, social networks, and WhatsApp No. 987888632\u2014shall imply full acceptance of these Terms and Conditions, as applicable to the specifically contracted service.<\/p>\n

THE CLIENT declares that, prior to contracting, they have had effective access to, knowledge of, and full comprehension of these Terms and Conditions, as well as the specific terms applicable to the requested service. Consequently, reservation confirmation, acceptance of the commercial proposal, or service contracting shall constitute explicit consent regarding the conditions applicable to the provision of services.<\/p>\n

Acceptance of these Terms and Conditions is without prejudice to the rights recognized to THE CLIENT by the Political Constitution of Peru, the Consumer Protection and Defense Code, sector-specific tourism regulations, and all other applicable mandatory legal provisions.<\/p>\n

If THE CLIENT does not agree with any of the terms or conditions applicable to the service they intend to contract, they must refrain from confirming the reservation or completing the contracting process. Under no circumstances shall the provisions of these Terms and Conditions be construed as a waiver, limitation, or restriction of rights recognized by mandatory legal norms.<\/p>\n

  1. DEFINITIONS<\/strong><\/li>\n<\/ol>\n

    For the purposes of interpretation, application, and execution of these Terms and Conditions, the following terms shall have the meanings assigned below, unless the context explicitly indicates otherwise:<\/p>\n

    THE AGENCY: LUX ANDES CUSCO, a natural person or legal entity engaged in the commercialization, organization, coordination, and\/or intermediation of tourism services within Peruvian territory, according to the nature of each contracted service.<\/p>\n

    THE CLIENT: A natural person or legal entity who, of their own free will or on behalf of third parties, requests, requests quotes for, contracts, reserves, or makes full or partial payment for one or more tourism services offered or managed by \"LUX ANDES CUSCO\".<\/p>\n

    THE PASSENGER: A natural person who actually undertakes the trip, participates in the tourism activity, or uses the contracted service, who may or may not coincide with the person who made the reservation, contracting, or payment for the service<\/p>\n

    NO SHOW: A situation that occurs when THE PASSENGER fails to present themselves at the location, date, and time established for the provision of the contracted service, without prior notice of cancellation, rescheduling, or modification within the deadline and under the conditions established for said service.<\/p>\n

    FORCE MAJEURE OR ACT OF GOD: An extraordinary, unforeseeable, or unavoidable event beyond the control and reasonable sphere of influence of the parties, which makes it impossible, restricts, or affects, in whole or in part, the ordinary execution of the obligations related to the contracted service. It includes, as applicable and depending on the specific circumstances of each case, natural phenomena, extraordinary weather conditions, natural disasters, strikes, work stoppages, road blockades, social unrest, health emergencies, mandates from competent authorities, or other events of an analogous nature that satisfy the legally required criteria to be deemed as such.<\/p>\n

    EXTERNAL PROVIDERS: Natural persons or legal entities independent of THE AGENCY that participate, directly or indirectly, in the execution or provision of the contracted tourism services, such as lodging establishments, land, air, or rail transport companies, tour operators, restaurants, tour guides, tourism activity companies, concessionaires, and other providers linked to the service.<\/p>\n

    RESERVATION AND CONTRACTING PROCESS<\/strong><\/p>\n

    Inquiry and Quote<\/strong><\/p>\n

    The information, service descriptions, itineraries, rates, images, promotions, and other contents published by THE AGENCY through its website, social networks, digital catalogs, advertising material, electronic platforms, or other communication media are for informational and reference purposes only, subject to availability, validity, modifications, and the specific conditions established for each service.<\/p>\n

    The contracting process shall begin upon an inquiry for information, availability, or a price quote made by THE CLIENT regarding one or more specific tourism services. In response to such inquiry, THE AGENCY may issue and send a quote or commercial proposal containing, as applicable, the service description, itinerary, date or period of provision, included and excluded services, price, currency, offer validity, payment terms, and other applicable specific conditions.<\/p>\n

    The quotation or commercial proposal shall be valid only for the period expressly specified therein. Once this period has elapsed without THE CLIENT having accepted it and fulfilled the necessary conditions for the reservation, THE AGENCY may modify the rates, availability, itinerary, or other conditions initially communicated, without any obligation to maintain the original proposal.<\/p>\n

    The issuance of a quotation, commercial proposal, or availability notice does not, in itself, constitute a definitive booking confirmation nor does it guarantee service availability until all contracting and payment terms established by THE AGENCY have been met and the corresponding confirmation has been issued.<\/p>\n

    Booking Confirmation<\/strong><\/p>\n

    A reservation shall be considered validly confirmed when THE CLIENT has accepted the quotation or commercial proposal, made the required deposit, advance payment, or payment within the established timeframe, and THE AGENCY has verified service availability and issued the respective confirmation through official channels.<\/p>\n

    When a pending balance applies, THE CLIENT must make the payment within the deadline and under the terms previously communicated by THE AGENCY. Payments made by card or other payment methods may be subject to applicable fees or commissions, provided these have been disclosed in advance.<\/p>\n

    Expenses arising from bank transfers, international wire transfers, or other costs associated with the payment method used shall be borne by THE CLIENT, as applicable and where previously communicated.<\/p>\n

    The mere execution of a payment or deposit does not, in itself, constitute booking confirmation until THE AGENCY has verified its proper identification and issued the corresponding confirmation. The reservation shall likewise be subject to any specific terms established by the EXTERNAL PROVIDER, where applicable.<\/p>\n

    Passenger Details<\/strong><\/p>\n

    It is the responsibility of THE CLIENT to provide THE AGENCY with truthful, accurate, complete, and updated information for all individuals included in the reservation, ensuring that the first names, last names, and other details provided match THE PASSENGER'S official identity documents or passport.<\/p>\n

    THE CLIENT shall be held responsible for any errors, omissions, or inaccuracies attributable to them that directly result in modification, correction, or reissuance fees, penalties, or other costs effectively charged by the respective provider, provided these are duly substantiated and directly linked to the information provided.<\/p>\n

    Tickets, entry passes, reservations, and other nominative services shall be personal and non-transferable, unless the respective provider expressly permits their modification or transfer. Likewise, they shall be subject to the terms of modification, rescheduling, cancellation, and refund established by the corresponding provider, which will be communicated to THE CLIENT when applicable.<\/p>\n

    This provision shall apply without prejudice to the rights corresponding to THE CLIENT under applicable Peruvian legislation and, in particular, consumer protection regulations.<\/p>\n
